Are all HOA's in Tennessee regulated ? If so, by whom ?

Does each HOA have to be registered in the state of Tn ?

Is there a websight to check to see if our HOA is listed ?

Are Hoa monies taxed ?..meaning does an HOA file any type tax report yearly ?

Thanks

Gail,

All HOAs must file a Fed tax return. If your state has an income tax then they will have to file a state return also.

Hopefully Donna will weigh in on the HOA TN laws. I don't believe there are any, but I may be wrong.

Gail,

All Tennessee HOAs are registered as non profit corporations with the State. If you mean are there any Tennessee laws that are HOA protection and governing laws, then, NO there are none unless you are a condo or time share. Let me know if you are one of those.

To see of your HOA is registered with the State, there are 2 ways to find out. Do you not have governing documents for your HOA which should tell you this information. If not, the contact your County Register of Deeds and ask them or contact---

Tennessee Secretary of State

312 Rosa L. Parks Avenue (8th Avenue)

William R. Snodgrass Tower, 6th Floor

Nashville Tn. 37243

of if you have the patience of Jobe, Go to the Secretary of State website
Go to the Business search tag , have the legal name of the copr (HOA) and-----GOOD LUCK!!!

All non profits must file a tax return with the iRS

Gail,

Unfortunately TN has virtually no laws regulating HOAs other than those that apply to non-profits, and from what I'm discovering even their application to an HOA is subject to a lot of legal interpretation!
