I have the neighbor from hell (preferred weapon of choice is a Jeep Cherokee Laredo SUV...) who installed a basketball hoop on a paved area (shoulder of the road) on the border between our houses. It is loud and just very annoying - not to mention unsightly. Our HOA president had added rules 1 year ago (when he took over the HOA..) to the HOA rules (not the CC&R) that "basketball hoops are allowed but must be brought in when not in use". Recently he held a election (by email... which I think is a crock) to make it permitted to keep them in the street all year around. Basically this has resulted in our streets being used as a playground - and many more to be erected soon I'm sure. It makes it difficult to back out of my driveway and to navigate some of the streets (for example cars parked on the street on one side - kids playing in the street on the other). So now basketball hoops are allowed on the shoulder/street area of properties - or so our HOA president says... Is there any language in my CC&R or county zoning laws I should look at that might help me fight this.

Note - while the basketball hoop is on the shoulder (which is my neighbors property - but with egress rights), the hoop itself hangs over the community street.

IMO, your BOD needs to rethink the portable basketball unit rule. Here is my HOAs rule for portable units:

"Portable basketball units will only be allowed if they are stored out of public or private view when not in regular use and must not be on the sidewalk or street."

I believe the BOD defines "regular use" to mean daily use. In other words if the unit is not used every day it must be put behind the wall. "Out of public or private view. . ." means behind the wall. My HOA is walled in and each home has a wall around the back yard but I know this is not the case in neighborhoods in other parts of the country. If the portable unit cannot be stored in the garage or the back yard it could be required to be camoflouged with landscaping.

Katherine, what do your CC&R’s say about basketball hoops? If they are allowed then the Board probable can enact a rule about placement as long as it doesn’t contradict the CC&R’s. For example if the CC&R’s only allow temporary B-Ball hoops then the Board or the president can’t make a rule that permanent ones are OK. I would also consider calling the local zoning board, if the streets are city or county owned then quite probably the hoop infringes on their easement.
