Our townhome style condo buildings have double wide garage doors. The garages are all attached being half tucked under the deck and half under the home.
The metal edge trim on the garage door opening is apparently attached to wood bucking as the wall construction is concrete block (so there needs to be something for the metal opening trim to nail to). The head, or top, of the opening wood bucking is/was glued to the opening's steel I-beam header. The glue gave away and the board is sagging in the middle a good 3/4". The question came up if a repair would be an association issue. Our documents don't specifically say anything about exterior door trim, or much else on exterior doors for that matter. I'm having difficulty finding anything on exterior walls too. (We have alot of work to do on these documents).

So...Anybody in a townhome style condo building have any experience with what is and what isn't included in association's responsibility as far as exterior walls, doors and door trim? Since it is only affecting one unit, I see that if the association is found responsible, the charges would just be turned around and assessed to the owner. Otherwise, the owner is responsible. The unit was bought as-is, unfortunately, so going after the builder or warranty is most likely not an option.

JohnK11 - Each associations description of common and limited common elements are different. Your governing documents should specify what are the common, and limited common elements. Maintenance and replacement of those is usually that of the association. In my North Jersey association the doors and windows are the responsibility of the homeowner to maintain and replace, exterior door trim is that of the association.

You are right to be checking your documents to determine the responsible party. If the documents are not clear or do not speak to this at all, than your directors need to develope some appropriate language to make clear the division of responsibilities between the association and the owner. The develop and approval of this langauge should follow the process defined in your documents. In some cases, these requirements may be considered amendments to your declaration. In this case, there is usually an owner vote needed to approve. Any amendments would need to be recorded at the town or city clerk's office.

In most cases, the exterior of the building is a common element and the responsibility of the association to maintain. The cost of the repair should come from operating funds (if a small repair) or reserve funds (if a larger repair or replacement). As such, all owners will share in the cost of the repair, not just the owner of the unit needing repair.
