I need adivse on a situation that recently presented itself to your HOA.
A new owner bought in to our small complex of 6 units and discovered hidden
undisclosed water damage and potentially allerginic mold.
The water partially came from the two adjoining units they are sandwiched
between from a tub and shower and the majority from their unit itself.
The HOA has tried to be cooperative and wants to correct any repairs
that they are liable for in this case a sill plate and flashing that have
to be replaced. The HOA does not want to engage the master policy as they
are on probation having filed 2 unrelated water claims in 20 years. We
will be canceled. We are not even sure this is something that is a HOA issue
but more of an individual owners policy issue.
This new owner has requested that the HOA idemnify them against all costs
assestments to repair their unit as well as any medical costs for
them or any of their visitors in perptuity and a litany of other things.
They are refusing to cooperate with the HOA and won't even disclose the
professional inspections they have carried out.
The HOA board has vetoed any such indemnification.
The situation is escalating rapidly and getting very ugly.
I guess my question is the HOA responsible for any of the interior repair
, mold mitigation costs to remedy the situation in this unit?
