someone who has not been voted in but put on a committee. Do they have to follow rules provided by the HOA

Some one on a committee who will not follow rules, was removed from one committee now wants to go on the bylaws committee. Does she have to be accepted, also does the board have the right for committee members to follow guidelines or rules. thanks

Committee members serve at the pleasure of the board. They can be appointed to a committee or removed from a committee as the BOD sees fit. Just because a member wants to serve on a particular committee does not mean the BOD must bow to their wishes. Of course they have to follow the rules of the committee they are serving on.

A written rule for what? Your bylaws or CCRs should state that committee appointments are made by the BOD or the board Pres.

Common sense that if you have HOA rules to follow, they must be followed. If this woman does have violations, why would any sensable Board allow her to serve on a committee for them.

If you are looking for a written rule, you might look under either violations or enforcement in your Bylaws where it would say what violations would be in your association but it will probably not say that she cannot serve on a committee..

I would venture to say, "No."

In that case, there is no obligation whatsoever to place anyone on any committee that the board does not see fit placing that person on.

So she (and possibly whomever is trying to advocate for her appointment) has it all backwards.

Until this person, or anyone advocating for installing her on any committees, can provide the above language that says all must be accepted, then she is S. O. L. for appointment to the committee -- any committee.
