We have a member of our Community who tries to control all aspects of the HOA Board and always complains about something not being legal. This person brings these complaints to HOA meetings. This person takes up a lot of time in meetings, gets the audience going and most people walk out of the meeting when they talk. I may also mention this person has been on the HOA Committee for over 20 yrs, but is not at the present time. How does the Board legally deal with this unruly person with out upsetting some of the crowd?

1) Develop a comment-period time limit, and stick with it.

2) When anyone, this resident or otherwise, presents the opinion that something is "illegal," thank that person and have him/her submit, IN WRITING the exact code, statute, law or covenant that shows the illegality.

We have implemented strict rules to prevent this:
1. You must sign a sheet indicating you wish to address the Board.
2. You have 3 minutes-always at the start of the meeting.
3. You may not address a specific Board member.
4. The Board will NOT respond - but may take your comments under advisement.
5. There are no comments from non-board members during the balance of the meeting.

You have gone "above and beyond" what the Fla. Statutes require.

Unless this is an annual MEMBERSHIP meeting or the individual has circulated a petition with 20% of the membership signing he/she has no "right" to speak at all at a BOD meeting. Furthermore the BOD has 60 days to add the petitioned item(s) to a meeting agenda and the right to speak is ONLY for the petitioned item(s).

Print a copy of FLA. 720 showing the law and say you are FOLLOWING the law (now)!

Thank you all for some very helpful information. I believe this will help with solving a very long standing problem in our Community. I am very new to all of this and have learned alot over the past 6 months. This website is the greatest!!!!!
