Attend another HOA Board Meeting in Florida - Is it open?

Greetings,

First off, what a great resource this forum is. Wish I had stumbled across this many years ago.

Our HOA adjoins another HOA which is going through some pretty significant turmoil. They have an upcoming board meeting for which they've posted notice throughout their community. A few of the board members from our HOA would like to attend, as a silent observer, the other HOA's meeting.

I've been looking through the, The Law of Florida Homeowners Association, Sixth edition, but can't seem to locate whether these meetings are open to the general public.

If anyone could weigh in, that would be great.

Fla. HOA meetings are not open to non-members but the "other" BOD could allow non-members in if THEY wish to.

What do you mean by "Our HOA adjoins another HOA" ? It physically is located next to yours or you are joined by some common element, documents or something else. Suresh is correct. There is no Florida Satute that says a meeting is open to outsiders or visitors but a HOA per their documents can allow othrs to attend. It must be in your own bylaws.

Why doesn't the members who want to attend simply talk to the BOD of the other HOA and see what they say about attending or has this already been done?

Hi,

To answer this and a few other questions.

This is a small community of single family homes. The communities are right next to each other and share a common street.

At this time, it appears that the neighboring HOA has recalled their Board of Directors (who were trying to clean up the community) and is looking to potentially dissolve the HOA. According to their website, there are no active Board members.

What their community does, directly impacts our community and HOA, so we have an interest to attend and get the latest information.

99% of all HOA web sites are never updated. Dont trust a web site.

They had board members there two weeks ago and we were notified by their former president that they had successfully recalled the board.

In order to execute the recall they must have members named to "step-in" and take over.

Thanks, but I'm pretty well versed in how a recall works and this wasn't (and isn't) my point. My original question was about the ability to attend another HOA meeting and I believe that's been answered.

Jeremy,

Our governing documents state board meetings are open to members which are owners.The board can allow renters or others guests. So check your docs and the Florida statures on meetings. Hope this helps!
