How do you handle non-compliant homeowners who violate landscaping ARC covenants? Can we go on the property, cut and clean and then bill the homeowner?

Yes you can do this if it is stated in your CCRs. However, remember that when you set foot on private property w/o the member's permission you are trespassing. Even if allowed in your CCRs make certain the member is notified that this is the action that will be taken if they do not cure the violation w/i a certain specified time. Then if the violation is not cured by that date send another letter, by certified mail, letting them know that the work will be accomplished on a certain date. IMO, you should proceed very carefully with this.

Just out of curiosity (and in an attempt to help you answer your own question), how does your HOA currently handle any non-compliance or covenant violation?

As mentioned above, you should follow your HOA's controlling documents on covenant violations.

If your HOA does not already have a compliance policy (drafted in line with your documents) then it would be in your HOA's best interests to create one immediately.
