I am a board member at a co-op containing 200 members. Before any construction takes place a county permit must be in hand. A registered surveyer
must be hired to stake each lot for proper setbacks and compute allowable square foot of living area ,additions, sheds ,etc. This proposed survey is submitted to the county with the permit application. Once permit is granted the county inspects and issues approval in writing for each county requirement. Upon completion, an as-built or as constructed survey must completed to receive a final inspection to receive your certificate of occupancy. The county issued occupancy permits to a dozen owners who had installed screened rooms, which have a thin vinyl coating for windows. These are three season room for RV,s. Three years after issuing accupancy permits the County wants these windows removed and will fining those who do not comply.
The County code ,they now say, permits screen only. Do these owners have any legal recourse? Is there any State law,covenant,or statute that could help being they received occupancy permits with windows in place at the time if final inspection.
