The HOA for the neighborhood I live in has not had a meeting in 17 months. They haven't elected officers in about 2 1/2 years. We pay dues once a year. The current "president" and one neighbor continually make decisions without voting or input from neighbors. We have no idea how the dues are being spent. We receive no information. At what point are they in violation of the law? How can they continue to collect dues without a real board in place? Can they continue to spend the HOA money without letting the residents have input or knowing how it is being spent? This situation is very frustrating.

It would appear things have gone from bad to worse in the 2 and half years you mention, but I must begin by asking - how have you and your neighbors allowed things to get to this point? You haven't had elections in 2 years - how is it that your "president" continues to run the show? You pay dues and don't have a clue as to where the money's going - why hasn't anyone gone to the president and the other neighbor and demanded answers?

You don't say how big your neighborhood is, but then again it really doesn't matter because if everyone's had these questions and no one's gathered the other neighbors together and had a showdown with the "president", naturally he or she will do whatever suits his/her fancy.

So, that's your first step - go to this president and demand answers. He/she may not listen to you alone, but if you bring others along, it'll be pretty hard to ignore.

Then go find your bylaws and CCRs and read them - talking 'bout revolution is easy, but action is what counts. You may need to get a lawyer or two (or make a threat to do so) to get receipts, contracts, cancelled checks, account statements and other documents to make sense of where the money's going. Then, begins the work of appointing people who will do the right thing. You'll also need to enact various checks and balances to make sure everyone does the right thing. Good luck!

First read your CCR's, bylaws, rules and regs, whatever it is that governs your association. If you don't have a copy of these, contact your property manager and/or board president. You might need to pay for a copy, but it will be weel worth the cost.

We are required to have a certain number of open board meetings each year. I would think your association would have similar requirements. First, find out what the board is suppose to be providing in terms of notification to owners. Then kindly request the board follows through by adhering to tyhe covenants.

Put everything in writing, be civi and courteous in your communication.

Ask for copies of the budget. We are required to submit the budget to all owners each year prior to board approval.

You need to find out your rights and then act on them.
