What is the proper procedure when the builder is almost complete and ready to turn over the HOA to the homeowners? What is the best way for the homeowners to represent their best interests in the transition? Do they retain counsel? Do they hire their own HOA management company to review the builders HOA management companies budgets, HOA funds, outstanding covenant issues, maintenance omissions, amenity omissions, etc. How do the homeowners get their outstanding common area issues addressed with the builder and have it recorded and/or addressed properly prior to the builder pulling out?

Do the homeowners have any recourse when it comes to getting the builder to leave the community with undamaged streets, curbs, drainage and proper pool and clubhouse parking areas? Is there any correlation between clubhouse size, pool size, tennis court area, total number of developed lots and the amount of parking spaces provided?

Lots of questions, any guidance or suggestions on where to seek guidance would be appreciated.
