In my very last post we were about to get a special meeting we petitioned for. At the eleventh hour the President resigned. He tried every thing to avoid being recalled. He even tried to prevent a meeting of owners should he end the original meeting (Sad). We now have a election coming soon to fill the void and also to add one more owner to the board to total 5, which is much needed. We will add 2 more after for a total of 7 as written in the original bylaws. Not doing this now is a long story!
I was informed this Ex President is now going to run and says he'll be taking his Presidential place back as to finish his term. He now is trying to blame someone of forcing him to make his decision. He was told that he could resign or be recalled in front of all the owners. I held 19 proxys myself to have him removed. We have 203 homes in this non-profit , recall was going to happen if he liked it or not.
My question is can his nomination be denied? Or are we stuck dealing with this ego for round 2?

He can be nominated, but that doesn't automatically mean that the membership will elect him. If the membership was aware of the problems with him and there is somebody else running against him, then odds are he will just lose the election.

Even if he does get elected back onto the Board that doesn't meant that he gets to 'take his Presidential place back.' Depending on what your governing docs say, more than likely it's the Board members who decide who holds what office. If the Board members don't want him as President, then they just need to select somebody else for that office.

BTW: someone else may indeed have told him that he could resign or be recalled, but ultimately it was still his decision to resign.

It seems like a simple answer to me. If there were enough signatures or votes to recall him, where would he find enough votes to re-elect him? Your team better pound the pavement, making sure that everyone knows that he is going to run. It's all up to your side now.

We're hitting the pavement as soon as he officially nominates himself. I wish the recall could have happened, but he'd probably try to run any way. I guess he just needs to be embarrassed to get it!! Their are a few who I think are encouraging and stroking his ego. I just wish we could prevent his nomination in the 1ST place (sigh). We do have some good people who are going to run and unfortunately a couple of his buddies are too. I wonder if he does get in if we were to call a meeting and recall him ??
