Hello Fellow HOA's:

I have a questions that I've been unable to answer by reading the CC&R's. I live in a small HOA commiunty in So. Cal with 50 homes and only 3 board members. I would like to change my front door with a door with a light in it (an oval window). Can I just change the door without asking the board? There is no architectural comm., only the board.

What types of questions should I be asking, if I need to get approval through the board? If the board, rejects my request what recourse do I have?

Any help is much appreciated, since, this is my first time living in a HOA.

You should read your CC&R's and the Rules and Regulations and any architectural guidelines. If you don't find any, then go to a meeting and discuss it with the BOD. If they have architectural guidelines, then have them provide you with a copy.

Ask the procedure for making changes such as the door. They will probably ask you to provide them with a photo of the door to check to see if it falls within the guidelines.

By reading the guidelines, you'll know if it fits. If they deny it, then request a variance, in writing.

If they don't approve the door, and don't approve a variance, and if their decision is within the guidelines, then there is no recourse except the courts, and the court will most likely uphold the decision of the BOD as long as their decision is in accordance with the guidelines.

If your governing documents prohibit changing the door, the Board will tell you so. If they do allow for it to be replaced, I'm sure that someone will tell you what your options are and what needs to be done.

The Board represents you and the other unit owners. The interaction does not need to be adversarial.

I wish I had some better advice to give to you. I’m new to the whole HOA thing myself. I spend endless hours reading previously written posts and responses.
I know in our CC&Rs is states that Owners shall not alter, remove or add any improvements to any entry feature constructed or erected by the Declarant or the Association on any Lot, or any part of any easement area associated therewith without prior approval in accordance with the provisions of Article 6 hereof. All homeowners have to submit an ARC request form and wait for an approval or a denial.
