We send notices and then file liens when owners are delinquent. Fortunately we have 2 out of 125 problems thus far.

Problem 1) We acquired unclear title to one home and are collecting rent to offfset the loss of income until the bank takes it over. Though I am worried we may be obligated for real estate taxes - I'm just not sure. Has anyone had to fork up taxes in a similar situation?

Problem 2) A 2nd home is in process of being foreclosed, but the homeowner removed all contents, appliances and built-ins, making it uninhabitable. I advised the board NOT to acquire it. Any suggestions are welcome.

3) I just read a very interesting article (see attached). I am curious if anyone has been successful with their attorney's in speeding up the foreclosure process to minimize loss of association revenue.

Thanks I heard about that trial but did not know the outcome. What is your source of this article? I think if the situation arises we will send this to our attorney to see what they think about pulling this off in washington

Re Problem 1: If the HOA foreclosed on this home, and real estate taxes were delinquent, they most likely would have been paid after the mortgage co and before the HOA.

I was searching the internet specifically for legal blogs with topic HOA foreclosure and stumbled across what appears to be a viable option if we could not immediately recoup fees by leasing a home acquired by our association.
