can our elected officals vote of road repairs and who will do them or is it only the non-officials?

Candice,

Do you mean elected officials of the Board or of your County, City or whatever? Who will do them? What does that mean? Road repairs, meaning roads within your community? Please give us more to go on. Thanks

Anyone who is a Member (in good standing) can vote on his/her motions or elections.

Just because a person is an elected official, if that same person is a member of your HOA, he/she can vote.

I'm not really understaning your question.

sorry i'm not well spoken ;)

yes, our HOA officials..can they vote on road repairs. They are talking of cutting the road out from under my driveway. Our community is hilly and when i am situated, removing the road would cause severe damage to my driveway, water cutting under it and causing it to break off and then i wont be able to get up my driveway. No one would certainly help me, they way behave now.

Candice,

Your HOA officials should be the members of the board of directors. Normally they have the authority to make repairs w/o input or a vote of the members. However, all this should be spelled out in the CCRs (another reason why this doc is an important piece of info for each member to have).

It sounds like the road work they have planned would require consultation of an engineer. It seems to me that if they undertake a project that damages your property they would be liable for the repair. That's what would happen if you were to damage the common areas (the areas owned by the HOA) so I cannot imagine the reverse wouldn't be true if they damaged your property. I would think the contractor they hire would also be concerned about performing any work that would damage a property owner's property.
