Back in December we hired a local contractor to do some big handy work in our clubhouse. I would say just short of Christmas 09.

After the buzz of the holidays and at our first meeting we noted we had a check paid to the contractor in the amount sent on or around the 10th of January. It' turned out the management company cut a check to the contractor but provided a completely incorrect address to which the $1000 check was mailed to. This was found out shortly after the check was mailed. Here it is... more than 2 weeks later and no check from our management company has been provided yet to the contractor despite the screw up at the management office.

We have been asking weekly as that is when our checks are cut. This last batch did not have his check in it again, and when we inquired about it... it looks like once again we are getting a promise to have a check cut this Friday.

Is it time to let our PM go?

Some HOAs have a hair-trigger and fire property and management companies over the first issue.

But my HOA has gone through a couple of companies and I've concluded that, while you may wish for the moon with these companies, you won't get it no matter how many you hire and fire.

I know that I'm going to draw fire from some regular posters but I have pretty low expectations from these companies. I just get whatever I need done from them and work through the remaining issues.

So, is the company slow, dumb and amateurish? Feel free to fire them and hire some other slow, dumb and amateurish company.

Noelle, what happened to the FIRST check that was sent? Did they order a stop payment on it? Was it cashed? Was it sent to an address that has ties to the contractor? There may be a reason the second check has not been cut.

AHh hemm.. I am the treasurer. I signed the check along with the information provided to me by the management company. The check was returned to us within the first few days of the unknown addressee receiving it. Truth is the PM cuts checks to us on a weekly basis. We along with our vendor who is not wanting to finish his job because of the late payment has been waiting now about 5 weeks.

I would say if this is your biggest problem with your PM, you have it pretty good.
Seems like a simple mistake (maybe stupid), but still not the end of the world.

So far, you have the check back so I would return the first check to the PM with a big read "void" across the front and tell them in no uncertain terms you expect a correct check for the contractor within 5 days.

We have interviewed many PM's and have concluded that they are all a little sketchy, so choose the least evil one. Your's so far has made a stupid mistake and is apparently dragging their feet, but nothing to warrant replacing them.

Be firm, make demands, they work for you.

Just an observation. Someone said that the regulars here would object to firing an C/M. Where did that come from. As long as the M/C works for the Board, and take that to mean, does what the Board wants.............no problem. As soon as the Board starts to work for the M/c, fire the M/C and recall the Board. The M/C serves also as an expert opinion asset. They should know their job and they should be good at it, but they do not run the association. When the M/C becomes more that an employee, they have to go.

To clarify and put a fine point on it, I said that regulars might object to me saying that most or all M/Cs suck.

But, more to the point, the "fire the bums" mentality doesn't work. People love to toss around the idea of firing the M/C or recalling the Board but, as a practical matter, doing that is (A) a lot of work and (B) usually results in a bunch of new people who don't do a better job than the previous set.

My HOA fired a M/C and hired a new M/C. The reasons were mostly baseless and irrational. The new M/C only worked out better because I was voted onto the Board and made the M/C effective.

Many Boards are dysfunctional or ineffective. No M/C is good enough to fix those, no matter how many M/Cs you hire and fire.

Well we have most M/C suck, it is too much effort to buy new ones, the Board members are all dysfunctional, no M/C can fix that. Is this because none of the M/C are any good or all the boards are dysfunctional. Over the years we have seen countless associations, for whatever reason, grab hold and turn their neighborhood around, there has been no shortage of dysfunctional boards, M/C, presidents, dictators, illegal operations and a bunch of good folks trying to help themselves. I hear too much on this site about how rotten associations are and prayers go up to God to deliver them from ever living in another HOA, and it is true, not everyone should live in an HOA. It is also true, you got to live somewhere and frankly the majority, by far, of the people living in an HOA, come and go like night visitors, they get a long pretty well there, they contribute nothing and when they are gone, leave nothing. But think about today, if you want to move? "Anywhere but an HOA is not a choice," think about it. Would you take your children and select, anywhere but an HOA, your elderly parents, a newly divorced single mom or dad. Fine to say and I am sure the words are true at the moment, but there are other determining factors that contribute to where you live, and an HOA could well be the lesser of the evils.

Actually, I am ok with HOAs. I'm ok with M/Cs, too, because I know to make them effective.

But I do keep in contact with other HOAs in my area. They are having lots of troubles and M/Cs, even our M/C that manages those other HOAs too, aren't making those HOAs work.

Noelle, unless the person that returned the check wrote VOID on it, I simply would have mailed the returned check to the vendor with a note apologizing for the delay with a short explanation.
