We are a new Condo Association (developer recently turned over) in Illinois and I found out that our treasurer might be a board member of another local association. I plan to ask him at the next meeting if this is the case or not.

I am not accusing the guy of doing anything wrong, but I wondered if anyone knows of this situation being a problem, conflict of interest, conflict of law, etc. The fact that he never told anyone about his being a board member elsewhere during elections or in meetings made me think he might be hiding it for a reason.

I am not sure how it could be a conflict of interest because the two associations don't conduct business together. My guess is there is nothing in your docs that say anything about being on another board. I would view it as a plus, he has experience and is willing to do it, but that is my opinion.

Randal, I concur with Brad. You need the experience and probably no one directly asked his bio. You will find after living in a HOA that experience is a huge plus and non-experience can be difficult. Are you on the board too?

Being a new board member myself I found out that I could only be a board member if my name was on the deed. I needed to be current on my assessment and a homeowner residing in the community.

I would assume his documents don’t saying anything similar to this. I know it is very difficult to find other homeowners to be more involved with their community by being board members or even on a committee. I would also assume that these HOAs are voluntary? If that is the case I think it pretty impressive to do what he is doing, if it isn’t effecting you or either community (that he is a board member of) then you shouldn‘t allow it to bother you either.

If he isn’t doing a good job then that’s when it would be a problem. Until then, if he is doing a good job then just let it be.

Does anyone else have this same concern? Just curious.

Yes, I am on the board as the President. This is the first time I've done association management...and a first for a developer turnover, for sure.

If the board member in question has experience, he isn't bringing it to the table. In fact, we became suspicious when he called another board member, had her confused with someone at another board (we suspect), and just started spouting off issues about how someone was trying to get him kicked off this other board he may be on.

He seems to be more of a "title" guy than someone who volunteers for the good of the building, but that's just my opinion.

My question is are the people on the board owners? If so and their elected, then there is no problem, however just to agree to be on a board without being an owner or renter might be a long term problem unless they have a legal, accounting or massive past board experience. If the gentleman in question is an owner in more than one association, he may have some added benefit and then again he may just bring a whole bag of sour apples from another area. I would meet with him one on one and find out his reason for being on the board, as well as during your meetings as president always have an agenda and stick to it, leave an open area towards the end for members to add to the agenda and discuss, however do NOT let members run the meeting, set the agenda before hand.

Everyone on the board is a homeowner.

I'm planning to ask him about his commitments elsewhere, but I wanted to ask folks with more experience if they know of such a situation being a problem, illegal, etc from past experience (that I don't have).

Whats the big deal. Personally I would welcome a member from another association with open arms.
My personal belief is I wish to God that each and every City would hold planing meetings with HOAs and Condo Assoc it would help hugely. You folks have no idea of how frustrating it is to deal with city hall that totally ignores local HOAs,condo associations.
Especially here in Florida it should be manditory its not so we do our best to ignore them as they are more of a hinderance than anything under the sun.

The boards job is to protect the interest of all owners in the association, putting people without any ownership or interest in the association would NOT promote the best for all and without this attitude the board is not doing their job and never will. Remember people its not that hard, everyone is equal in the association, boards have no super powers, they are there to do a job, if they don't do their job they can be removed or sued. The association is here to protect and serve a lot like the police only in the subdivision, sometimes we all need to get back to basics
