i was just told that i was the president of a hoa here in florida. with no knowleggde of it at all.. they had meetings an made an discussed problems of the park an was never told anything of it at all..then after several months of this going on...i was removed as president an a new one was asigned ....is this legal...dose a hoa have the rite to do this?

It doesn't sound like you were properly elected in the first place, so there would be no "removing" you.

Just make sure they are properly electing the next president!

Normally Directors are elected by the membership. If there is a vacancy after the election the remaining board of directors may appoint a director to serve until the next election.

Officers of the Association (President, Treasurer, VP, etc.) are appointed by the Board of Directors. Usually the officers are also Directors of the Association but do not have to be. Officers serve at the pleasure of the Board and may be appointed, removed or replaced by a simple majority vote of the Board.

Were you or are you serving on the Board of Directors as an elected or appointed director?

The procedure in most HOAs is as follows:

1) The membership elects the board members, and
2) The board members, in turn, elect or appoint specific board members to fill the slots for the officers.

The officer positions can change from time to time if the board members feel this is necessary.

In your case, if your bylaws set the procedure as I have outlined, you should have been elected or appointed by the board. And when you were removed and someone else made pres, there should have been another election or appointment by the board.

There are some assn's that do require the members to elect the officers, but this is not the norm. If that is the procedure in your assn then you would have had to be formally removed as Pres by a vote of the members.

thanks tim, at the time was,nt aware of any homeowners association of any kind..from what i was told an understand that i was never to find out anything about what went on.. but as the old saying goes .. loose lips sink ships . an well make it a point to sit in on the next meeting..

Please excuse me, but I find what you are saying to be absolutely unbelievable. You didn't even know there was an HOA and then were told you were the Pres. Then all of a sudden you were told someone else is the Pres.

I'm sorry, but it appears we're not hearing the whole story!
