can a husband and wife be on the same hoa boardand or be officers----i have complained that i felt that they cannot be---i feel under florida law that they cannot---but i cannot find a wriiten statue

There is nothing in any of the 720 or 617 Statutes stating that a Husband and Wife cannot serve on the same Board. Only your own governing by-laws will have that restriction. Were they elected or one getting an appointment while the other was already on the Board?

John...are you covered unti 720 or 718? Because there sure ARE laws in the Florida State Statues that prohibit that! The laws were passed last year.

we are covered under 720---i have tried digging up everything i can on a husband and wife on the board--if its legal---we wer advised by a lawyer who answers hoa email that it is illegal since 2008---but he did not give the statue----the question was from another hoa----it mind stumpping that that can be allowed and i hope its not---its like having two vots for or against anything we bring up---thank you for any info

Can you provide that section of the law? I looked at FL Statute 720 which says:

"All members of the association shall be eligible to serve on the board of directors, and a member may nominate himself or herself as a candidate for the board at a meeting where the election is to be held."

I did a little more research and there was a bill passed by the Florida House that may have had this clause (I didn't read the whole thing but it did deal with modifications to 718 and 720). However, this bill died in the Florida Senate.

Thanks my Friend, for giving me a Sunday morning project.

I went to the site that Tim posted and DID find an amendment to 718 but I did not see where it passed. I'll continue my search but this is what it says.

From 718:112 BYLAWS--- GENERALLY :"In a condominium association of more than 10 units, coowners of a unit may not serve as members of the board of directors at the same time".
