Hello again all, we are having our annual election next week and I read somewhere the counting of the ballots are monitored by one of the officers. Can anyone tell me where I read this?

If you read that here, it was not sound advice. There should be a committee or at least 3 non involved observers from the membership who observe. Candidates have the right to appoint an observer as well. A Board member who is not running for office may also observe but best advice is to have more than 1 person.

Glenn, could it be that you read that in your own governing documents?

If not, have you still checked them to see what they do say about the election process?

Our ballots are opened at the annual meeting, given to the secretary, who then confirms that each ballot is being cast by an eligible voter, and a committee of 3 then count the ballots.

Advice here. Anytime you get Michelle, Donna, and Me agreeing, that is a miracle, if Mary and Glen1 post and agree, it's a double miracle. You may have posted the one post that everone will agree on. Great start for 2010

Yes, I remember Donna and Robert from the last time I was looking for answers and I thank all three of you. I did not read it here, I did think I read it in our documents and that is why I am puzzled that I can't find it again although my wife thinks it is normal for me. Anyway it is not in the by-laws or anything else I can find so I'm going to use the advice I got from you all. We do check to make sure they are eligible to vote so there is no problem there and I will make sure there are observers and we do have a committee of three to count so at least I was close. Thanks again and a Happy New Year to all.

i,m un sure to your queswtion as i have been appointed president to my hoa an had no knowledge of it. it seems theres alot going on that we the owners are unaware of.. i would think that there would have to be aleast two or three people appointed to count the votes that are not in the elections

Here is a guess about what you are saying, I think.

You my friend can not be appointed to be president of your association.........period.

Here's how it goes normally and I bet your HOA is normal and does some things it has no authority to do.

The people elect the Board members by popular vote of the membership as directed by their documents. Once the Board is formed, the Board then elects the President and the officers of the Board as directed by your documents. Those elected by the people to the Board must accept the election and mandate of the people and can decline to accept.

The Officers of the Board must accept the election made by the Board or they can decline to accept.

Once the Board and officer are voted in as above the Board then decides how the association is going to be managed and if so moved then hires a manager, management company or elects to be self managed.

Every step of this is done in a appropriate meeting as directed by your documents. A record of these proceeding are entered into the minutes af the appropriate meeting , recorded, submitted to the Board and a vote is taken to approve the minutes.

We have two members who are present at the meeting volunteer to count the votes and report to the secretary.
