six owners are running for three spots on the board.we are told that if you vote for more than three,your ballot will be invalid.we are then told that you can vote for less than three owners. how is this possible(legal)if there are three spots to be filled.

Even if you forget about what the laws state, this is a no-brainer. If someone marks more than the three names, which 3 names should be given the vote? There is no way a vote counter can possible interpret the ballot, thus the ballot becomes ambiguous. Ambiguous is just a big word for invalid.

However, if you vote for fewer than 3, the vote counter knows exactly who to give the votes to. After all, you can vote for 0 candidates if you want.

This is no different than national elections. You can only vote for the number of seats that are open; however, your ballot will be counted if you vote for fewer than the seats that are open. This procedure allows you to refrain from voting for a candidate(s) you do not support. In many elections I choose to not vote for most (sometimes any) of the judges on the ballot mainly because I don't have a clue who most of them are and what their records are.

2) Fred
3) Mary
4) Bob
5) Nancy

Scenario #1) I don't care who gets my vote, so I mark all 5 names down. The person counting votes should not be determining who to give the votes to and they cannot award more than 3 votes, so the ballot gets tossed. It's invalid.

Scenario #2) I don't know Mary, and I don't like Bob & Nancy. I only mark Joe & Fred's names. They get 2 of my 3 my votes.
