I noticed that there were not 2 homeowners who witnessed and assisted with the tally of the votes--which raises suspicion. Would this make the election void?

Also, would any homeowner have the right to view (or get copies) of the tally sheet and homeowner sign-in sheet used for this purpose? Thanks. -Renee

In my opinion you picked a hard item to hang your hat on. There should be verification of the vote by what your documents say. The underlying question here may be, why are you suspicious and I am guessing there are other concerns and maybe you feel this is something so cut and dried they have to pay attention and they will fess up to all their wrongdoing.
I see you have 159 posts here, so you have probably read that many and more posts.

Is it really about the vote verification? Let's say it is. I would pull out all the voting procedures you all follow, and attend a Board meeting and direct the question to the Board with a statement and offer the evidence in the documents. Ask for clarification. If they push you off and don't allow your comments to be entered, I would have explained before the meeting I would be taping your section of the meeting. Then I would ask again it be placed in the minutes. That's all. I would then go back and write them a registered letter with the question and cite your references...ask for a time limited response, No response in reasonable time frame, hire a lawyer and have him/her write the same letter. Somewhere they will respond.

I doubt it will just void the election if you did ask the question, boards don't cave that easy, especially if you have to be suspicious of them. They certainly have the authority to void an election if it was not conducted as the documents indicate. Personally, I would work for a change over the long haul, may take a long time to change directions if the Board is just skirting the regulations for their convenience.

The results should have been announced at the meeting. Tally numbers and all. All this should be stated in the minutes of the meeting.

Was the election close? Unless your concerns will verify a close count, then most likely the board will not act to declare the election null and void.

Work to make future elections go more smoothly.

You noticed that the 2 H.O witnesses were missing? What role do you play in this? Unless someone contesses the results, there is no reason to declare it void. But this is a matter of the Board being lax in following your election bylaws and it should not happen again. YES! a homeowner has the right to view the tally results. It should be posted or viewable for everyone.
