I noticed that there were not 2 homeowners who witnessed and assisted with the tally of the votes--which raises suspicion. Would this make the election void?

Also, would any homeowner have the right to view (or get copies) of the tally sheet and homeowner sign-in sheet used for this purpose? Thanks. -Renee

Renee,
You can ask if there is written verification and numbers on file. Our association seems to verify everything then shred it, I think. Why not ask one of the people assigned to count and verify the votes, I expect they are your neighbors, they should be fellow owners.

According to our documents, as least one board member is to witness the vote tally.

Another board member is to witness the vote verification.

So, I guess where I'm going is, you should probably check with your governing documents.

Also, you would probably need to get an attorney's input on whether something like a "tally sheet" is considered part of the "association records."

Are notes that a board member keeps during a meeting part of the association records, viewable by members if requested?

Are the drafts of the budget? What I call the "What-If" sheets?

I don't know.
