Dear HOATalk

Our HOA is looking into changing our Mgmt company. The problem we are having is the other Mgmt companies have refused to add us to their policy as a added insured.
Since we carry D&O insurance separately for our officers (one Mill each) Why is it necessary for the Mgmt Co. to insure us as well?

Is this a normal practice for the Mgmt Co to add us to their policy also.?

Sounds like they must want YOU to insure yourself against their actions, if they should do something wrong, etc. They probably have their own internal liability contract and don't want to add their customers to that.
Just my guess.

In our policy, the MC is listed as an additional insured under our policy. I am not aware of the reserve being true.

People ask to be added as "Additional Insured" all the time without truly knowing what they are asking for. Essentially when you are added as an Additional Insured on someones policy they are *sharing* their coverage with you. It dilutes the coverage.

Look at it this way: If the Mgmt company *shared* their coverage with ALL their customers, it would dilute it a lot! It may happen, but as an insurance agent I would advise the Mgmt company to avoid adding customers as an Additional Insured if they don't have to. It may also cost the Mgmt $$ to add an Additional Insured, it just depends on the insurance company.

So to answer your question, no it is not normal practice for a Mgmt Co. to add you to their policy.

That's what they do and how they protect themselves; our contract states that they are indemnified thru our policy. WE are paying for their protection. Standard practice and I don't go along with it.

What I was asking was how many out there have the Mgmt co add their HOA to their insurance ~ We have always added the Mgmt Co to our policy as standard practicr however.

The board is telling us they can't change Mgmt Companies because the new ones won't put us on as "additional insured" ~~ Changing Mgmt Co's would save us about 4K a month ~~ The board has made friends with the old Mgmt Co, and is looking for excuses not to change.

Our bylaws specify the minimum required insurance. Beyond that, I guess it is up to the board. I am not familiar with any HOA in my area that is listed as additional insured on the MC's policy.

Not finding a MC that will list you as additional insured seems like a crafted excuse. Have you seen verification that you are indeed listed on their policy?

I would think for 48K a year, you would at least be able to increase your HOA's coverage to account for the lack of MC policy coverage and still come out way ahead! IMHO, this is not a valid reason to stay with the existing MC.

I'm not sure if it matters, but our bylaws specifically say that the ASSOCIATION shall carry the coverage.

Good question, Dee. We have both D&O AND Umbrella coverage.

I've never heard of a mgmt requiring the BOD to be put on their ins policy. Usually it's the reverse; the manager is covered by the HOA's insurance. Are you sure you didn't misunderstand the request?

Apparently no one else has heard of it either ~ Me thinks our BOD is trying to look for excuses to not change our present MC ~ to much insurance when it is not necessary.

Our high paid attorney is telling the board she wouldn't feel comfortable unless the Mgmt Co agrees to indemenify us with additional insurance. ~~ But then we must remember the Mgmt Co is a collage friend of the Attorney, she is the one that reccomended them, with no other RFQ's sent out... Their price came in at double what the last MC charged us. That is why the homeowners want to change.

If the added insurance is the only reason being presented as the arguement to stay with the over-price MC, I'd ask the board to get a quote on what it would cost to up your HOA's insurance to the "comfortable" level the attorney feels necessary (if it is higher than what is required by your CCRs and state law) and directly compare that to the cost of the other management company ... odds are that you would still come out ahead by switching EVEN if the HOA paid for and bought the extra coverage. It would nullify their argument for staying with the same MC ... if cost is the only issue.
