I am just a homeowner on the board and would like to know how to go about filing a lien on another homeowner because they did not remit HOA dues? Any input would be appreciated.

This is generally handled by a lawyer acting on behalf of the HOA board. There is an upfront fee to file the lien, ($125 each here).

Sharon, do you have a management company or are you self-managed? Also, do you have an association attorney?

It IS important that you stay on top of delinquencies and filing a lien is the first step. But we have our attorney handle all of this for us. The first thing he does, though, is send a "30-day Intent to File Lien" letter to the homeowner.

Make sure you're following all the proper proceedures.
