The HOA represents homeowners yet park owner is negociating rates for Cable,directTV ETC. as well as garbage rates for homeowners. is this legal? Does Park owner have to go through HOA for aproval?

Do you rent or own the lot? His name is probably on the contracts as the representing agent and he would do that negotiating. We need more specifics about the park

There lies your answer. The cable, garbage etc are normally provided to the owner of the property, aka the owner of the park.

If he wants to be a real nice guy, he would include your Board in the negotiations but he certainly has no obligation to do so. He basically is the owner of the land which provides access to these services and you pay him for them.

Since you mention "park owner" I'm wondering if you live in a mobile home park. If so, there are different statutes that apply. Even though you have an HOA, the Park owner has certain rights since he owns all the common areas. Check out state laws and also thoroughly read your CCRs to see exactly what the HOA is resp. for.

I must say that the park owner unbundled monthy rent charges not HOA. The TV and Garbage were included in monthly rent charges. Now we pay the TV and Garbage charges seperately How can the owner negociate the contract with the different cable, direct TV etc. without the consent of owners. after all the owners pay the bill.

You haven't answered my question as to whether or not you live in a mobile home park, but from your remarks I am led to believe you do. My remarks are based upon this assumption.

IMO, if TV and garbage services were included in the rental agreement you signed then the park owner has the right to decide which providers he will use. Now that the h/o's are paying for these services separately, has the park owner lowered your monthly rental fee? If not, then you may have a complaint to file with the agency that oversees mobile home parks.

I suggest you take a look at the FL Mobile Home Park Lot Tenancies statute which can be found at: www.flsenate.gov/statutes -- Title XL, Chapter 723.
