Are there any requirements for number of days between when candidate nominations are closed and ballots for board election must be sent to homeowners? Can ballots be sent out in anticipation of an election day that is tentatively scheduled? What if election day is postponed to more than 30 days after ballots are sent - any limit to postponement?

The ballot should be included in the annual meeting notice and your bylaws and state law most likely specifiy how many days b/4 the scheduled annual meeting the notice must be mailed to all the members. Knowing this, the board should indicate by what date the nominations must be received in order for the names to be included on the ballot.

Betty, I'm just curious....are YOU a recalled Board Member who wishes to run again? Or are you afraid that someone who was recalled may run again?

That would depend on what your governing documents (and possibly any state regulations) have to say about the election process.

In our association, our governing documents specify that all nominations must be received by the third Monday in January. Ballots are then to be mailed out on February 1.

The ballots must be returned to the HOA post-marked no later than February 21 and are to remain SEALED until the night of the annual meeting, which is the first Monday in March, at which time they will be opened, verified as eligible, and counted.
