Can an HOA deny membership (in good standing) access to the Clubhouse as a method of obtaining current contact information of the owners, in order to "true up" member files?

Covenants and Restrictions do not make mention of this, and reading the Rules and Regulations, it only mentions that access to the Club facilities is by use of "security key only", and specifies requirements for "Guests" and "Special Members (Renters).

Well, why on earth would owners/members want to hide their contact info from the association to which they belong?

The HOA already has my address on file. I live down the street from the Clubhouse. My question though is if they are capable of locking out paying membership when there is no requirement in their rules.

IMHO yes they can as long as once they have the information the member is allowed to enter. We periodically change the pool gate key and everyone has to que up and sign for a new key. Ohio also has a law that requires homeowners in COA's to update that type of information within 30 days of a change. Could you fight it in court and win; probably but it would be expensive.

Kevin,

It sounds like you have way too much time on your hands. In my opinion this is not worth discussing.

strictly speaking, probably not.

However, I would say the HOA has the right to determine that you are indeed an owner in the association, and require proof of that.. such as your current address, photo id, etc. Which would be what I said I was doing when i denied you access to the club. "Just making sure, your honor, that he was indeed an owner, and the only way to do that is match his current information with our files."

but i would think there were better ways to get such information than the big stick threat.

Kevin,

I'll tell you what this reminds me of. At least once a year, my doctor's office requires me to take a look at the contact info they have on me and sign that it is correct, or make appropriate changes. Each time I go to an x-ray or lab facility I must do this also. It's just a way of making certain they have your correct info. Perhaps that is all the clubhouse is wanting to do. If they do not have your correct info on file they are probably justified in denying you access to the facilities. The fact that you live down the street from the clubhouse is meaningless. I would suggest you just verify your current contact info and be done with it.
