I need everyone’s help with an issue. Our covenants have been intrepid, in the past, to allow sheds on lots. During the annual meeting there was a discussion about discontinuing this and a committee was formed to come up with the best way to go about this. The committee’s advice to the BOD was to change the covenants and an example of the recommended change was submitted to the BOD for review. The BOD decided to accept the recommended change is working toward getting it prepared to be sent out for a vote in the community.

A lot owner has submitted a request to put a shed on his lot.

Does the BOD have any grounds to sit on the request, until the vote has out and the purposed covenant change been decided by the community? Getting a vote in our community can take up to six months.

Or, should the BOD decide base the current wording of the covenants.

IMO - if you can tell the applicant that a vote is pending SOON, then perhaps he will withdraw his application.

If your CCRs outline the time frame for processing applications, you may miss the deadline and the applicant should be allowed to build as usual.

PS - what are you going to do about all the sheds currently on properties?

Check your documents. In my HOA failure to take action on a request will amount to approval after 30 days.

In the meantime, I don't think you have the right to put this on hold while you consider a change in rules. If the request meets the current rules, then it should be approved.
