There are 12 townhomes in our HOA. There are a few units that have not paid there dues for months. One has not paid in over a year. Per our by laws we assess a late fee and a 6% penalty monthly and we have placed liens on these units. Despite these actions the units have still not paid. Does anyone know if we can start foreclosure proceedings or what our next step might be?

Check your gov docs and also state law. In AZ foreclosure can only be started when the delinquency reaches $1,200 or is 12 months past due, whichever comes first.

Since your assn is so small I'm thinking the board members know all the members. Since this is the case would it be possible to have a little talk with these members (especially the one who may be facing foreclosure) to find out why they are not paying? This must be placing a strain on the paying members of the assn which, in turn, may be placing strains on friendships. Not a very pleasant situation, I would think!

Talk to your attorney, take them to small clains court, that's the Hot Thing here.
You can get a judgment and attach their property, faster then going the foreclosure route.
