Our bylaws/CCRs states that all board members are to receive leases within 10 days of
execution.

The only person who rents in our development is the builder/Declarant who owns and rents 9 units
(there are only 28 homes built in our development).

He has renewed leases and there have been new tenants that moved in a month ago. Although I have
emailed our PM she has not sent the leases to me or the other board member is our development. She was
hired by the Declarant so she doesn't do anything without checking with him first.

The Declarant is ignoring us and not abiding by the bylaws. I guess he feels that he is exempt
because he is the President and his corporation has the majority of the votes.

I would appreciate any suggestions...

Why would board members receive copies of leases?

IMHO - This is an administrative issue and should be handled in house. The PM can report to the board about any leases in the community.

Still, if your CCRs state this, the board has the right to see them, but it seems odd.

Maureen, I've read your different posts of problems with the developer and how upset you are over some of his actions; we have all said this in one way or another but it seams like you are h*ll bent to do battle with this guy. While the Declarant is in control he pretty much has carte blanc to do as he pleases including ignoring his faux board, changing CC&R's etc. Now you can rally the H/O's and get them to cough-up funds to hire an attorney to do battle with him (which you will probably loose) or you can try to get along as best you can until transition. I'm not saying his actions are right, I'm just saying it's still his sandbox.
