I'm not familiar with NC law; however, this is an issue that I would be surprised to see addressed in state law. I would think the answer would be "no". Are your docs silent on this or do they specifically say "no"? If they are silent and there is no state law, then I would definitely say "no". Just think about it. Why would a board member have this benefit that no other member of the assn who is running for a board position would have? I really feel safe in saying this is a definite "NO"!!!

Please tell me the other board members are NOT going along with this!

Ryta - can you be more specific? Some people might think that an HOA newsletter with a column written by the president is his/her way of "campaigning."

Mary as they say: "Never say never." Your over regulated under funded neighbor to the west put it in their laws. Civil Code ยง1363.04. Campaign Funding

I didn't say "never"; I said I would be surprised to learn it was addressed in state law. Frankly, I found the Davis-Stirling Act to be quite lacking and am really surprised to know that campaign funding is addressed. But, I guess legislators "know" about campaign funding! Too bad Ryta isn't in CA.

Certainly by HOA standards, never doesn't always mean never. But for my money it's a good place to start and make exceptions if necessary.

So, I would say with a strong conviction that ANY member of an association can not use HOA funds to assist or abet them in any way to get elected or re-elected.

This is one of the craziest posts I have read.

I hope Gloria M posts on this.

Am I wrong in believing a Newsletter is paid for out of HOA funds? If so, then the HOA decides what goes into the newsletter, not the individual. Can the BOD abuse their power by favoring individuals in an election? They can and do, but go after the Board not the individual.

Exactly how are HOA funds being used for self-promotion for re-election?

I mean, as a general rule of thumb, I think we all can agree that HOA funds should not be used to promote specific candidates.

But without knowing how that is being in a specific case, I can't say.
