Many of you have talked about those that are eligible to vote must be current in dues and assessments. There isn't anything in our HOA bi-laws addressing this. I cann't find it in state law, maybe I am not looking in the right place. I am in Arizona can someone direct me in the right direction. Thanks

Laura,

I'm sorry but I believe you will just have to scour your CCRs and bylaws looking for a provision which states a members' right to vote is suspended if they are delinquent in paying assessments or in violation of the covenants. In my former assn's CCRs it's under "easements and rights of enjoyment of common areas" and in my current assn's CCRs it's under "Enforcement; sanctions". It could very well be that your docs do not address this which would mean everyone can vote regardless of whether they are delinquent or in violation. You are right in saying it is not addressed in state law.

Sorry I couldn't be of more help to you.

Mary,

I agree with Laura. You will probably find this in your covenants and not your bylaws.
