The corporation most likely gets to set its own rules in how it handles its nomination process.

Do your governing documents disallow asking for pics?

Our nomination process asks for the nominees to write a brief statement on what they feel they would bring to the board.

As long as it's a uniform request. Write-in candidates and those nominated from the floor would not have the advantage (or disadvantage) of the process. So it would be only those "vetted" by the nomination committee.

Are you in a large association? It would be odd if my association (19 units) asked for photos, but we all know what we look like!

Shoot, I wish we could ask candidates for anything (statement, photos, idea of how associations should be governed...)! If we did, we wouldn't have any candidates! We're lucky to get a full board elected.

Let me ask this...why do you have a problem with the BOD asking for photos?

yes, it is likely lawful. Or more properly stated, there is likely no law against it (yet).

I agree Tracie. As long as photos are not being used to discriminate, I think it is a good idea to publish pictures. In a larger development, we often recognize people as we pass on the streets, but we're not able to put a name with the face or biography of the person. Knowing as much as possible about a potential board member could help us to make an informed vote.

I don't think you can ask for photo...would check with attorney first, but I know for resume's/applications for jobs...you CANNOT ask for a photo....called discrimination!

Hi, I'm unclear it is lawful but ask yourself if there is a value to having a photo in the mix when people are forming an opinion on trustees. I’m not sure how large your voting body is but can you say for certain that all voters will vote solely on the person’s credentials and not have a positive or negative bias based on visual cues a photo might offer in terms of age, sex, religion, creed, race, sexual orientation, physical or mental disability, pregnancy, occupational/social status, or nation origin? Just giving you some perspective to consider here.

Volunteering to run in an election for the BOD is nothing like seeking employment which is subject to an amazing degree of potentiall EEOC oversight.

The same way I find getting an image of the people I vote for for public office.

These are my neighbors. I don't know each and every one of them by name, but I might have run into them at the drug store, out walking my dog.

It makes it a more familiar vote.

"Oh, I know that guy, he's got the really great landscaping."

Or, conversely, "Opps, that's the guy with all the car parts in his back yard."

So, yeah, getting a chance to actually see the person behind the name would be immensely helpful.

In regards to the neighborhood, do people really think pictures would trigger any more unfair "discrimination" than just seeing the names?

Right-on Michelle,

My God, these candidates have to stand up in front of the membership and introduce themselves. At least with a photo attached, meeting them somewhere within the association property at least lets me know that they belong there. My picture is on my Visa card so where does this photo thing become not okay?

Substitute He for She where you feel it is appropriate.

Hmmm, a photo is kind of vague. Do they want a full body shot in a swimsuit, a head shot, side ways, no smiling like on passports etc etc. I can see this will add a few new pages to the rule book.
