The president of the board in my building broke the law by anonce on open meeting violation of the rules and the regulations. She created a war + she takes sides, threatening, created an unlawful meeting, using people the run petitions for her, denying the civil rights of the owners and much more.
How can you fight that?

You can follow the rules and replace her.

And if she is denying the civil rights of people, you can have her sued, or possibly arrested and tried in court.

I am curious what civil rights she is violating...

The civil rights of the homeowner-to challenge any rules and regulations-the rights to run a petition.
She is not following the declaration-she does staff on her own way.

Please don't call these "civil rights" - you are talking about member's rights in a non profit corporation.

Members elect the board to run the HOA. Hopefully, they make good decisions.

If the members don't approve of the board's actions, they can vote to recall the board and elect new people.
You need to find out how to do that, if you are serious about getting rid of this board.

Iordanka,

I think you may need to thoroughly review all your governing documents: articles of inc, bylaws, CCRs and board adopted rules & regulations. Determine exactly what provisions this board member is violating and determine what can be done about it. Oftentimes a member(s) will "perceive" that the Board is doing something illegal or not in accordance with the gov docs or state law when in fact they are not. Before making accusations you should know exactly what provisions of the gov documents are being violated.

If you would like our opinion it might be a good idea to post the actual CCR provision and/or bylaw you think she has violated along with a specific description of what she has done.
