Double question:

In a Condo that allows Golf carts of owners and Guests to be parked on the premises, should and can the board have authority to require insurance?

Does a condo BOD have the authority to require HO6 Insurance?

In my mind both of the above fall under the authority of the BOD and provisions should be installed that require and confirm the presence of both kinds of insurance. I suspect many condos allow Golf Carts to be operated and garaged on the common property, doesn't this signify responsibility?

Should/do/can HOA's require and confirm Golf Cart insurance by the individual owners that utilize the common property of the association. That could be roads, parking areas, recreational areas, etc.?

Is any of this covered under any general blanket insurance liability the Condo carries? Generally.

For the difinitive answer, contact "The Villages" down in Florida where they may have 20 to 40 thousand of them flying down the streets. God take care of those poor people on foot.

If they do, then they should for golf carts. IF they don't, then they shouldn't.

I would post a big sign saying that there is parking at your own risk and the HOa is not responsible for damages or losses.

Ye gads, don't even open that door (for liability) unless you are required (which I doubt).

I certainly don't possess grand knowledge in this area, but all of these situations I have seen (about 6 or so) have had such requirements contained within the HOAs governing documents.

So obviously it CAN be done, but I'm uncertain if it can be accomplished with just BOD rules vs. CCRs.

Does your HOA carry liability insurance to cover roads or any other common property. Liability wold be an issue if you do.

As far as I know all condos have to carry liability insurance with their blanket policy along with Fire, Flood, etc. How can you open an open door. The issue is about Golf carts and should they be insured by the individual owners when on common property. That involves liability, I think. Now since we live on an Island and we (Island)is managed by a POA, the POA inspects (safety) and asks for proof of insurance coverage to cover the vehicle on the common property of the POA. The question is does this cover the Golf cart on Private Property (Condo)when parked or driven there. If not, then should the Regime require the owners to cover this situation also. I think they should. Suppose a car catches fire in the garage resulting in damage to a golf cart stored or parked in the garage. Sure, you can say it is the owner of the cars fault and he is liable for all. But the authority for the golf cart to be there was granted by the regime and in our case could well be that the golf cart was stored on common property the the owner is paying rent to the regime. And as far as I can find out the BOD can rent out some common property for specific uses, as long as the property is not partitioned (actually sold). I remind you that condos do levy a charge for such things as a Pool house or community rooms or special pool parties.

My word, we sure can find more and more ways to worry about things here. I agree with Brian. If you inspect insurance for cars, then do so for golf carts. The job of the HOA should be maintaining the property, not parenting the inhabitants.

Really, some things are best left alone until you have to worry about them. Chasing down insurance policies on golf carts will drive up costs. It will not save you any money ever. Not now, not in 20 years. And if you take up this responsibility, then you could actually increase your liability when the proverbial ball gets dropped on one case that happens to get into an accident.
