I posted about a week ago concerning issues we were having with our Treasurer writing checks to himself without presenting to the BOD/officers for approval. He was unable to provide receipts for the purchases, and that together with another questionable transaction, led the remaining BOD/officers to remove him from office.

Our community also has another association where the members are property owners who have a lot on the pond. The Treasurer for the pond association was the same person who served as our Treasurer. He has been removed as Treasurer from the pond assocation as a result of our removing him from Treasurer. Subsequently, the President reviewed the bank statements for the Pond assoc. and noticed the Treasurer had also written checks directly to himself without approval. Based on what the President for the pond assoc. said, the sums were actually pretty large in comparison to ours. However, he was concerned about confidentialtiy and did not believe he could share the nature of the information with the BOD/Officers for the entire community assocation (to which he and the other pond owners also are members) because none of the BOD/Officers are members of the pond assoc.

I did learn the Treasurer was asked to reimburse the pond assoc., and he did yesterday. We are meeting with an attorney tomorrow to find out if we can seek reimbursement for any checks he wrote to himself and that which he does not have an actual receipt.

My question is this: Is the matter of the Pond assoc. confidential because none of the BOD/Officers for the community assoc. are members of the pond assoc.? I would like to discuss the issue of the other pond assoc. with the attorney we are meeting with tomorrow because I think it might provide more support when we seek reimbursement from the former Treasurer. I would like to ask the pond assoc. President if the former Treasurer is reimbursing 100% for the unauthorized and/or unapproved checks, but since he mentioned it might be "confidential", I am unsure if he will provide any details. He did mention there were 2 checks, but did not elaborate.

Explain your issues to the PaP and request the info on the conditions you will share it with only your attorney and that the info will otherwise be kept confidential until PaP says otherwise. Or, ask if your attorney can contact PaP personally, also on a confidential basis.

I would suggest you pull in your horns and let the situation bubble for a while and see what your attorney or their (Pond) comes up with.

No way would I stick my associations neck into the Pond association business AT ALL. You have plenty of time to file for money or follow any claim you all may have against this person that was fired.

Now if there was an ongoing court case I would ask your lawyer about petitioning the Judge to hear your case also or something like that.

I fear this firing business COULD be the issue you fall into if the person fired decides to contest the firing.

I also caution you not to make decisions based upon what someone has told you unless you can prove the veracity of the information.

Frankly I don't know that you should be concerned about having all this info from the Pond Assn. All you need to worry about is your assn and getting the money back from the former treas. for expenses he cannot prove. The fact that he did the same thing to the other assn only confirms his lack of trustworthiness. I can't imagine what info the Pond Assn BOD would have that would be beneficial to your case. If the former Treas cannot come up with receipts to back up the reimb he gave himself, the BOD would have the authority to ask for that money back. Whereas it's good to know he pulled the same "scam" on another BOD, I don't know that they can help your case.
