we are a small minor subdivision of 5 homes we are on the same water well we have 2 homes not paying the hoa dues which include water dues they are now 1 yr behind any advice would be greatly appreciated

check your codes and bylaws, and enforce the rules given there. Perhaps you can cut off their water supply, I don't know, but the limits of your Boards' powers are spelled out in the CC&R's and By laws.

People who don't pay their dues are stealing services from the folks who do, so don't hesitate to collect. you owe it to the good families to enforce the rules and collect equally.

Recently, in N. Carolina, a condo association cut off the utilities (water) of delinquent owners. The court there upheld their right to do so. As was stated above, check your documents to see if you have the right to stop services to delinquent owners.

If shutting off their water is a possibility then do that. What ever privileges you can take from them, do so. Do you have any amenities? Did you send them a certified letter, requiring a signature? Inform this homeowner that legal proceedings will be the association next means to recover these delinquent assessments.

I’m sorry to hear of your problem. I hope you receive the advice you so desperately seek.
