I have found NOTHING in the CC&Rs about residents leaving their bagged garbage outside their door for a day or so. I know it is potentially a problem as it pertains to rodents, looks, etc but..... if there is no law against it, what is one to do? I do not know how to go to the archives here to see if this was discussed in the past.

I would look again, perhaps under nuisance/pest/insect/property care areas, or perhaps use of common areas (if you are speaking of condos with common hallways). Most places have some kind of boilerplate language about "care and upkeep" of a home, preventing "nuisances" or creating nuisances/attractions to pests/insects, or language about what can be done in common areas.

Your board can adopt new language to specify this behavior is not desired, and incorporate it under an existing rule (see above). It shouldn't be impossible to manage the issue.

Contact the local health department.

Ooops, hit post too soon.

Not all problems need to be handled by the association. If there are city/county/local ordinances dealing with garbage, all people who reside in that city/county/local need to abide by the laws (association regulations or not).

The Board can pass a Rule and Regulation on this asap. Next meeting, put it on the agenda. Florida Statutes REQUIRES!! you to send notification 14 days prior of any changes to the rules. So compose it, and send it out. Then it is ready for a vote by the BOD at the next meeting. Include concequences for failure to follow the rule.

Why would garbage bag set-out times expect to be found in the CCR's?

If your HOa does not have a Beautification Committee, establish one, then get a community rule written. Otherwise look for local ordinances about garbage set-out times.

Is the assn resp. for picking up trash? If so, then they need to develop a rule which states what day and what times trash is to be put out. If out any other day and/or time then a violation notice is sent.

Alex, If this is a condo, check the description of all the units in the property. I bet you will find that out doors of any unit is either Limited or common property. As such it is under control of the Boards. The description identifies the property and responsibility and controls the property, the Board enforces. It is clearly Board responsibility not owner responsibility until it comes down to the Board not enforcing then the owners have the authority to demand enforcement.
