After 2yrs. of being president of our HOA, I've decided to step down and maybe run for it next year.There is a homeowner that was interested in the position and nobody ran against her so she will hold the position. The other offices of Secretary and Treasurer did not change.
I sent a letter out to all of the homeowners to let them know that at the end of my term I would step down(next Friday). To help the incoming President become familiar with everything going on,I went ahead and gave her the check book and other necessary documents to go over. I am still one of the 2 signatories on the checks.

First of all, are the officers elected by the members? In most assns the members elect the directors and they, in turn, elect the officers from among themselves. Please post your bylaws so we can read exactly what the procedure is for electing directors and officers. Thx!

Now, if, in fact, the members do elect the officers, I'm afraid you've gone about this in the wrong way. You stated your term ends next Friday then went on to say that another h/o who is interested in the position will become the new Pres. If your term is ending then the members must elect the new Pres. Someone who ran for the position in the past doesn't automatically now become the Pres. You should not have given her the checkbook and other assn docs. And you should not have sent a letter to all the homeowners advising them of your resignation w/o first sending a letter of resignation to the board which they would have to accept.
