We have jsut been adked if a potential owner could install a hot tub off the cedk behind the condo unit. We have allowed owners to have a 10' space off the deck of the condo for a garden( mostly flower gardens. The gard is the responsibility of the unit owner. If the unit is sold the garden can be assumed by the new owner, or the current owner has to return it to grass.
The deck would not support a hot tub. Could a new foundation be built for the hot tub?
He has requested that it be put in the 10' space that the garden would be. Is this a good idea for us? Is a hot tub a structure? What if there is a concrete pad required? How will waste water be removed? It would seem that some plumbing would be involved, and wiring? Would this be a detriment to the association?
We are not necessarily trying to say no, but would try to accomodate if the request is reasonable.
But there are many unanswered questions, and we are trying to cover all possibilties.
Any advice or information would be very helpful

I have a hot tub in my back yard. I didn't need prior approval because our properties are all walled in here.

There is no waste water to be concerned about. When the hot tub needs to be drained and fresh water put in, the water can just be drained into the grass. The hot tub should be placed on a concrete slab and yes, it would require elec work and a separate 220 line. There is no plumbing work involved for an above ground hot tub.

If there is no privacy issue (neighbors seeing the hot tub) I can see no reason why it wouldn't be approved. With only a 10' space available it would be a rather small hot tub -- perhaps one just large enough for 2 persons.

Doug - since you are a condominium association, wouldn't you be permitting this on "common property". I think you are opening a can of worms. If a concrete pad is poured who takes care of removing it when the people sell? Or, who pays to maintain any of this should there be a foreclosure (sorry, but this is Florida speaking).

My father had an outdoor hot tub without a concrete foundation. He used 6X6 pressure treated timbers for a foundation. But different soil may have different requirements. Even if you have concrete, the foundation itself could be placed below grade. If you do approve this, then I would make sure that this is done so that the area can be returned to grass without a major project.

The biggest thing I wonder about is will this be an "attractive nuisance?" Is there a way to secure the thing such that it doesn't get shared with the world? I don't see privacy as an issue because well obviously they won't have any and that is their problem.

I personally would consider it a structure. And if you say yes to this then you may get asked about a small shed next. That isn't to say that approving one of these precludes disapproving of another. Just be ready for some to dislike your reasoning.

Has anyone given any thought to the noise level, especially when someone wants to use it at 10 p.m.? The motors are not that loud but add a full bubble and it becomes pretty noisy.

I don't know that noise would be a factor. Our hot tub isn't that noise even with the jets on. The noise is noticeable to those who are in the tub, but I don't think it carries enough to be a nuisance. Of course, condos are closer together than single fam. homes. BTW, night time is the best time to be in the hot tub especially when the sky is full of stars!!

What if someone wants to build a shed in that ten-foot area; or a swing-set in that ten-foot area; or a sand box in that ten-foot area; or a dog pen in that ten-foot area; or a play-house in that ten-foot area?

Get my drift? Once you allow ANYTHING other than flowers out there you'll be opening up a whole can of worms for EVERYONE wanting to put anything and everything in that space.

It sounds like it is "common area" and if EVERYONE can't benefit from what is there you shouldn't do it. We allow people to plant flowers in the beds in front of their units and even THAT causes problems because the people on the second floor complain that they don't have a place to plant flowers.....again....an example of letting people use "common areas" for their exclusive use. It should never be allowed.

Just my thoughts.

I agree on all of the benefits of having a hot tub HOWEVER, when you are sharing tight spaces such as a condo type HOA, then your comfort must be shared by those who are in close proximity with you as for there peace and quiet. Hot tubs are not quiet when the motors and jets are running. They create enough noise to disturb all of the units around them. In condos. neighbors are required to not disturb other neighbors so unless you use the tub during the day, then they are a no go. In Alaska, daylight can run into night time hours so be considerate when thinking about installing the tub.
