Can our HOA eliminate or drastically cut out language in our CC&Rs that don't seem to apply anymore. Our community is made up of 43 manufactured homes which started out as a park but the landowner sold all the land to the individual homeowners. We want to clean up the CC&Rs and any reference to the one landowner and also we want to allow our homeowners the individuality to do what they want to their properties without "big brother" having to give permission. I want to know if our state statutes allows us as a group to do this.

Check out the language in your CCRs under the article titled "amendments" and "termination". If the majority of the members are in favor of eliminating the bulk of the CCR restrictions, perhaps the assn should be terminated and a voluntary assn formed. Or, perhaps only an amendment to the CCRs should be undertaken. This decision needs to be made by the membership and the procedure to follow should be outlined in the CCRs.
