What would be included under a Rules and Regulations sheet?

I thought I needed specific "policies" due to the Colorado (or Uniform) Common Interest Act thingy...CCIOA...

Yes, most of these are included in my bylaws and articles, but aren't completely "policies" as I would think of them.

I'm hoping we don't have to make many changes! We like our laid back association! We're just a working class neighborhood, and we don't have the time nor the inclination to start fighting amongst each other. Mostly, we do just live and let live... Hanging laundry...good for you! Supporting the troops...yaaayy! Signs in the front yard advertising political stuff...we're glad you're an involved citizen! I just can't spend my precious time worrying about that crap. Now, if they plant trees and the tree starts to affect the gutters...now you're going to have a problem with me. Otherwise...I couldn't really care less.

I've been trying to read all your posts to try to keep up with all your issues.

There are a couple of things I'd like to throw in my two cents about. This is in reply to this thread and also the one you wrote about your neighbor calling Code Enforcement.

Do you really want every neighbor knocking on your door about issues in your community? It really doesn't sound like he did anything wrong, by calling. He may be someone who doesn't know what is going on around there. Are you communicating with everybody in your association? Are you letting everyone know what is going on?

You may be a "laid back" community, but trust me, you will soon have that ONE neighbor who WILL object to political signs in the yards and laundry hanging out if it is indeed in the rules that those things are not allowed. Are you stating that you don't feel it's important to enforce the rules? That ONE neighbor can make your life a holy hell if they start demanding you enforce the rules.

You state that you "don't have time" to deal with those things. My question is, why are you a board member if every part of your duties is not important? Believe me, you have my sympathy, but being a board member is not easy.

If it's in your deed restrictions, then you do not have the luxury of determining which you will enforce, and which you won't.

If the neighborhood truly does want certain "rules" to "go away," there is really only one legitimate and proper way to do that: through a document amendment.

Even though your docs may say lack of enforcement of one restriction doesn't void the entire set, consistent and repeated lack of enforcement that appears to be cherry-picking could well void your ability to enforce all of them.

An accidental lack of enforcement would be okay. Or picking up enforcement after a time of lax enforcement might be good enough to protect the integrity of the documents. But the key to maintaining their complete integrity is consistent, fair, and and unimpeachable enforcement.

I also think you might want to re-think the statement about "just" a "working class" neighborhood. Last I checked, people living in working class neighborhoods work just as hard to keep their property values intact.

Cherry-picking enforcement depending on who's running the show this year or next is not the way to do that.

Trust me. If you want to be comfortable in what to enforce and what not to enforce, then get the homeowners to formally vote on what should be amended and what should be left alone.

You might be surprised at what bubbles up.

I know we were.

Originally our deed restrictions did not allow sheds. We figured people wanted sheds so we put up an amendment. It got voted down! We were shocked! People want SHEDS, but they don't want cra**y sheds! So they wouldn't approve a shed amendment until we produced one with very specific specifications on what would be allowable and what would not be allowable!

They also surprised us by voting down above-ground pools! All we heard for two years was how we have lots of families with kids; these are "working class" families; blah blah blah.

But when it was put up for a vote, boom. Voted down.

Keep it coming, all!!!! While I may think I know what's best, I really, REALLY appreciate comments on where I might be walking down the wrong path! I appreciate all the assistance with my obvious confusion! I'm printing this stuff out so I can take it home with me...
