Hi we are very new board members of an HOA and we ddont know what to do when a home owner refuse to pay their dues

Welcome Carmen. Your BOD needs a written collection policy which needs to be sent to all owners so that they know just how the Board will treat them. It needs to be tough but fair and conform to your CC&R's (Covenants, Conditions & Restrictions) & any applicable state law on the matter and IMO should be reviewed by the Association's attorney to make sure it complies. Ours for instance allows a 15 day grace period at which time a $35.00 late fee is applied. At 30 days the H/O looses the privilege to vote in Association matters and access to amenities. After 90 days delinquent we file a lien and at 160 we begin foreclosure proceedings. Once it gets to the lien stage we turn it over to the attorney and his fees and court costs are added to what the H/O owes.
