Hi, I am a board member in a small association, 30 condos, and a neighbor has put up an electric fence attached to the outside of their deck, which is in the common area. They refuses to remove it because "it is to stop raccoons from eating their homegrown tomatoes." Has anyone had any experience with a similar situation and what's your advice? Thank you, MW

The board needs to send a letter telling him the fence must be removed from the common area by a certain date and if not removed the board will have the work done and billed to him. The board cannot let this member dictate to them.

I also live in a small development (40 homes). We must get board approval before we can go ahead and install anything on the outside of our homes. I am on the board and had to get approval for a fence that I want to intall on the side of my patio for privacy.

Yes, as Mary has stated, send him a letter that the electric fence must be removed. Boy, can I see a liability issue waiting to happen. Let him put up some temporary short screening around the tomatoes. When they are done blooming, down comes the screen. Common area is not his to use and he should be made aware of this.

Living amoung all wild things including racoons, I can verify that his electric fence will not stop them so he must be a city slicker with little knowledge of these masked bandits. We had a mama coon up in Wisconsin who was teaching her 3 little ones how to get over our 8 foot wood fence. She scaled the monster oak tree on one side, moved past the fence line while WAYYYY up there with 3 little ones right behind and down the other side of the tree branches. Boom,after a 5 foot drop, there they were in the yard so they probably have the electric fence already figured out. I've seen them easily walk up and over 5 foot chain links like it was not even there.
