Help!

I was appointed as POA president quite some time ago for a small POA. I have been unable to get support for a few months for board members as all of the original board members have resigned. I would like to dissolve the POA in Arkansas. Can anyone provide any help on how to do that? The small common areas are still owned by the developer or at least he is listed as the owner and it has been over 2 years. There is some money collected in the bank accounts, what can be done about that? Anyone have any experience or thoughts?

Daniel,

The fact that the developer still owns the common areas makes me think he is still in control of the assn. If that is the case, then I don't believe the members could dissolve the assn. However, you need to thoroughly research your CCRs to find out what the exact procedure is for termination of the HOA. There should be a provision under that title. The reason I don't think this can happen if you are still under declarant control is that may mean the developer has the majority of votes and I doubt he would vote to dissolve the assn.
