With the help of this forum our homeowners recalled the president of the HOA in Jan. He has been asked to turn over all records/minutes/keys to file cabinets that belong to the HOA. He refuses, will not open door, answer phone. What can we do to get him to give us all the items?

Have your lawyer send him a letter.

Yup, DJ is absolutely correct.

We had to do that with our treasurer a few years ago.

Cost us $45. I say it was a bargain!

The SECRETARY should have the official minutes in a binder, along with other official papers.

Those may, in deed, be his copies.

He should, however, return all other items. Although changing locks may be in order.

Most definitely have an attorney send him a letter. If he doesn't respond to the demand letter the BOD can take legal action against him. Usually the letter does the trick.

The BOD should make a list of all the items he has to make certain they receive everything. When he does comply have him sign a release form that has listed everything he's turning over.
