Several owners go up and fix the chairs pool so they look neat. Tonight while I was doing it I noticed cigarette buts all over the floor. Does anyone have no smoking rules for the community pool? Is it in your bylaws?

I don't think that this is Bylaw fodder but belongs in Rules and Regs. The Board can just write the rule order without having to go thru the trials and tribulations of an amendment to your Bylaws. There are very few pool areas in HOAs that still allow smoking so it will not be an unusual rule.

We have the same, No smoking at pool in the R&Rs. The BOD can make this change through a Motion or better yet a Resolution (easier to record and find in the future).

It seems to me a "No Littering" rule would be appropriate, too.

Regardless of whether smoking is allowed or not, it's not only tacky to throw one's butts all over the place, but it could be a problem if the butts blow into the pool and get sucked into the filtration system. Among other issues.

If you don't want to do down the tricky political route of "no smoking," then come up with a strong "no littering" rule with concrete penalties.

OK....I've been watching this thread for two days and sitting on my hands to not type.

Our pool is ONE place where people CAN smoke. More smokers use the pool than non-smokers. The "clean air acts" of several states has not yet filtered into OUTSIDE areas, here,.....yet.

Florida was one of the first states to outlaw smoking in all INDOOR gathering places; few places exempt.

NON SMOKERS get the advantges of all common areas....with the exception of the pool area....at my place. It's outdoors. If MY Board made the pool a "non-smoking" area we'd be strung up. Of course we have more inconsiderate, low-class people here than the average condo community. The low-class people SCREAM the loudest. They're the same people who didn't want the older people to be allowed ONE HOUR per week to have the pool reserved for theraputic exercises.

Please don't berate me for calling people "low-class". Low class people at my place are those who fling the "f" word all over with no concern for the kids, or elderly or ME when screaming in the parking lot. The "low-class" are those who wash their cat litter box in the bushes....you get the idea....

Ok....I'm ready....start your rantings and tirates about "smoke".

I love you guys and always welcome your comments. Your comments are ALWAYS fodder (for me) for comebacks to issues! I thank you.

Or rather, a "No Littering" rule.

I am not condoning smoking, or littering, but I think it is reasonable to assume that if the pool is outdoors, there will be those who will smoke around it, and if there are no depositories, I would think that the absence would not imply a "no smoking" rule...

Now if these people ignored any attempt to keep things clean and organized, I would then believe establishing a rule to prohibit smoking or at least limit where it can take place, and assuming these people continue to ignore those rules, then you may have a good income generator!
