Mobile home renter in a HOA

Everyone in our park rents a space from the park owner, but we own our mobilehome, month to month.

We have a HOA which collects dues of $12.00 a year, not mandatory, and we have 15 Board members. We do not have any ownership in any common ground. Our HOA has an event once a month (breakfast or dinners) which we pay for at the door and meets every other month and serve donuts paid for out of dues. They act as a liasion with the park manager and inform the members of any issues. We have by-laws but they are not followed by the Board.

I call this a social club. We do file any tax forms and we are not a Corporation and our by-laws are not filed anywhere. So my questions are should we be a HOA collecting annual dues? Should we file as a non-profit? What are we???

Ida, it sounds like you are just a social club. You can continue just like you have been. Voluntary dues to join and be a member, not taxes need be filed, no need to file as a non profit.

I’m in the process of learning what a member of an HOA can and can’t do! I’m glad you got some advice concerning your questions.
I have to admit though, I’m a little bit jealous. You have 15 board members? WOW, very impressive. How big is your community? You don’t have any committee’s? What do all of you do, that hold positions on the board? I’m familiar with President, VP, Treasure and Secretary, what else is there?

My community is voluntary as well. We have 275 homes. We only have three members for our BOD. It’s a challenge just to get the three volunteers we do have! It seems to work, it just makes it very challenging.

You have turned to the right place. There are many very knowledgeable people on this discussion board.

Our park has 181 homes and approx 30 are part time residents. We don't have a need for committies since we only have a community event once a month. But what we do have are 'volunteers' that make coffee and serve refreshments on Saturday mornings funded by anyone who goes, volunteers that write and others who hand out a monthly news booklet which is paid for by outside advertisers and a volunteer that sends flowers to anyone ill or in the hospital. The flowers are paid for by a monthly collection from the homeowners.

As for the BOD, we vote in 6 and the others were asked to be on the Board and said yes. Other than the Pres., VP, Sec. & Treasurer the other BOD do not have any written duties. They (this is the first year to have more than 6) collected dues in January. Otherwise they are BOD's in name only.

Roger, thank you for your response. We have approx $4,700.00 in our treasury and I have checked civil code, corp., etc. to find anything that has to do with reporting this income. We have kept the treasury high "just in case" we have to pay attornies to fight a high rent increase "if" we get one. We are in Calif. and we are in a rent controlled park.

Ida, do you have over $100 in interest income. If so check out IRS form 1120-H.

It sounds as if you have good community involvement, then. I’m jealous.
Keep up the good work. It is people like you that give voluntary HOA’s a good name
