Hi all,

I'm a new board member in our HOA in Texas and have been asked to research property taxes on our lake. While I understand that these laws vary from state to state I am looking for a general example of:

Anyone with lakefront property on a "public lake" - one that a county or state organization owns & manages - ever protested a tax appraisal on the real property found on that portion of the lake lot that is below the high-flood line. (That portion of your lake lot not shown on your deed.)

This real property is usually a dock & boathouse that required the permission & inspection of the "lake authority" to be built.

It is "understood" that any structure on the "lake authority's" portion on any lake lot can be torn down or flooded by this "lake authority" at any time, for any reason.

Our tax appraisal district (and most do) taxes this real property (not found on home lot deed or survey) the same as the home & lot.

Has this topic ever been discussed or tested? Thanks! 22 HOAs around our lake want to know.

Around here (Michigan) every property has its own plat. And while the ownership of the lakefront property does extend onto the bottomland, no one has ever built on it. Docks can be attached to the property as a part of riparian rights. Any lake authority around here only monitors for weed problems, etc. The lake level is controled by the county, but official lake levels have been established, so there is no "flooding at any time" because of their actions.
